Jonathan P. Kieffer

Jon Kieffer is a partner at Wagstaff & Cartmell LLP and has practiced with the firm since 1998. Jon represents individuals and businesses as plaintiffs and defendants in a wide variety of litigation matters in state and federal trial and appellate courts throughout the country. His practice includes professional liability, products liability, business and commercial litigation including business torts, intellectual property and insurance litigation matters. Some representative results that Jon has obtained on behalf of clients include the following:

  • As lead counsel on behalf of the plaintiffs in a wrongful death lawsuit, Jon obtained a record settlement in excess of $3 Million against Penske Truck Leasing and others in a product liability case involving a rental trailer that decoupled on the highway resulting in multiple fatalities.   • As counsel on behalf of a corporate policyholder Jon obtained a substantial settlement in an amount twice the liability limits of an excess liability insurance policy in a case involving claims against the insurer for breach of contract, vexatious refusal to pay and bad faith.
  • As counsel on behalf of a corporate policyholder Jon obtained a substantial settlement against an insurer and its managing general underwriter (MGU) in a case involving claims against the insurer and MGU for underwriting errors and omissions, breach of contract and vexatious refusal to pay under a medical stop-loss excess insurance policy.
  • As counsel on behalf of a food products manufacturer, Jon successfully defended a patent infringement lawsuit, which was resolved with no payment of money by his client, wherein the plaintiff (a large food products manufacturer) initially sought damages in excess of $100 million for alleged willful patent infringement.
  • As counsel on behalf of an individual investment advisor, Jon successfully tried and defended on appeal a case involving allegations of tortious interference, conversion and violation of a non-compete agreement in relation to investor accounts valued in excess of $40 million.
  • As counsel on behalf of the elderly beneficiary of a revocable trust, Jon obtained a substantial settlement in a case involving claims for breach of trust and breach of fiduciary duty against a large financial institution after the trust was substantially depleted by the beneficiary's adult son.
  • As counsel on behalf of numerous physicians and other health care providers Jon has successfully resolved numerous medical malpractice cases by way of both trial and settlement. Jon also has represented a number of health care providers before their respective professional boards.
  • As counsel on behalf of various plaintiffs injured as a result of taking dietary supplements containing Ephedra, Jon prosecuted and successfully resolved suits against several supplement manufacturers.
  • Currently Jon is representing plaintiffs in various matters across the country arising out of fatal accidents that resulted from trailer decouplings and trailer sway involving equipment rented by companies including Penske and U-Haul.

Jon has been a speaker and presenter at various continuing legal education seminars on topics including healthcare and tort litigation.

Jon is active in community affairs and currently serves on the Board of Directors of Wonderscope Children's Museum of Kansas City. Jon led the legal efforts that resulted in the merger in 2007 between Wonderscope and Beyond the Book as well as the merger in 2008 between Wonderscope and The Children's Museum of Kansas City. In addition to serving on the Board of Directors, Jon also currently serves on the New Museum Planning Committee of Wonderscope Children's Museum of Kansas City which is committed to building a world class children's museum in Kansas City.

Jon received his undergraduate degree, cum laude, from the University of Missouri - Kansas City. Prior to obtaining his law degree Jon worked for the Federal Reserve System doing securities and commercial transactions work.

Jon graduated from the University of Kansas School of Law. While in law school he served on the editorial board of the Kansas Law Review and was selected by the faculty as outstanding student trial advocate. He also was awarded first place in the American Judges Foundation national legal writing competition for an article addressing medical malpractice law.

Jon is licensed to practice in Missouri and Kansas, the United States District Court, Western District of Missouri and the United States District Court for the District of Kansas. Jon is a member of the Kansas City Metropolitan Bar Association, the Johnson County Bar Association and the Ross T. Roberts Inn of Court.
